IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time. You are responsible for reviewing these Legal Terms periodically to stay informed of updates. The Services are intended for users who are at least 18 years old. 1. OUR SERVICES
Scanmy.ch offers a subscription service for creating and analyzing QR codes via the website.
The contract between the buyer and Scanmy.ch is handled in German.
To use the service, you must first register via email on the website.
Users have access to the “Billing” section in their dashboard to view invoices and cancel subscriptions.
2. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property
We own or license all intellectual property rights in our Services, including source code, databases, features, software, website designs, audio, video, text, photo, and graphics (collectively, the “Content”), as well as the trademarks, service marks, and logos therein (the “Marks”).
Your Use of Our Services
Subject to your compliance with these Legal Terms, including the “Prohibited Activities” section below, we grant you a non-exclusive, non-transferable, revocable license to:
- Access the Services;
- Download or print a copy of the content to which you have lawful access;
- Use all QR codes generated through Scanmy.ch for personal or commercial use, including those created during the trial period.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
- All registration information you submit is true, accurate, current, and complete;
- You will maintain the accuracy of such information and promptly update it as needed;
- You have legal capacity and agree to comply with these Legal Terms;
- You are not under the age of 18;
- You are not a minor in your jurisdiction, or you have received parental permission to use the Services;
- You will not access the Services through automated or non-human means;
- You will not use the Services for any illegal or unauthorized purpose;
- Your use of the Services does not violate any applicable laws or regulations.
If any information you provide is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use of the Services.
4. USER REGISTRATION
You may be required to register to access the Services. You agree to keep your password confidential and are responsible for all use of your account and password. We may remove, reclaim, or change a username if we determine it to be inappropriate, obscene, or otherwise objectionable.
5. PURCHASES AND PAYMENT

6. PAYMENTS, SUBSCRIPTIONS, AND REFUNDS
Subscriptions
We offer various subscription plans: monthly, quarterly, yearly, 14-day trial, free trials, and discounted plans for single to multiple users. Prices may vary by location.
Trial Plans: You must cancel before the trial ends to avoid charges.

- Click “Cancel Subscription” and confirm
Refunds
All charges are non-cancelable and non-refundable.
In exceptional cases, refunds may be issued within 30 days at our sole discretion. No refunds for accounts violating terms.

7. PROHIBITED ACTIVITIES
You may not access or use the Services for purposes other than intended. Prohibited content includes anything:
- Illegal, infringing, harassing, abusive, or misleading

- That infringes on copyrights, trademarks, or rights of others
- That breaches child protection laws or contains hate speech
Violating these terms may result in suspension or termination of your account.
8. CONTRIBUTION LICENSE
You agree we may access, store, process, and use your personal data according to our Privacy Policy and your choices.
By submitting suggestions or feedback, you agree we may use them freely without compensation.

- Take legal action against violators

17. LIMITATIONS OF LIABILITY
We are not liable for any direct, indirect, incidental, or consequential damages. Our maximum liability is limited to the amount you paid in the 6 months prior to any claim.
18. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims related to:
- Your use of the Services
- Your violation of these Terms
- Your breach of warranties
- Your violation of third-party rights
- Harm caused to other users
19. USER DATA
You are responsible for all data you provide. We do regular backups but are not liable for lost or corrupted data.
19a. DATA BACKUP AND DATA RESTORATION
Data backups are created exclusively for internal purposes and without any warranty. A restoration of data is—if technically possible—generally only possible retrospectively for up to a maximum of six (6) days. There is expressly no entitlement to the restoration of specific data sets, data states, or versions.
The decision whether, when, and to what extent data restoration or re-importing is carried out lies solely and at the unrestricted discretion of the company.
At the customer’s express request, data restorations or re-imports may be carried out—if technically possible—against separate remuneration.
Any liability for data loss as well as for the restoration of data is excluded to the extent permitted by law. In particular, any warranty for completeness, accuracy, timeliness, or the condition of the restored or re-imported data as expected by the customer is expressly excluded.
For direct and indirect damages, consequential damages, and loss of profit in connection with data loss or data restoration, the company shall be liable only in cases of intent or gross negligence. Any further liability is excluded to the extent permitted by law.
In all cases, the customer is solely responsible for the proper and regular backup of their data.
20. ELECTRONIC COMMUNICATION, TRANSACTIONS, AND SIGNATURES
You consent to receive communications electronically and agree that electronic signatures and records are legally binding.
21. MISCELLANEOUS
These Legal Terms constitute the full agreement between you and us. If any provision is unlawful or unenforceable, the rest remain in effect.
22. LANGUAGE AND APPLICABLE LAW
These legal terms are drafted in the German language. In the event of contradictions, discrepancies, or differing interpretations between the German original version and any translations into other languages, only the German version shall prevail. Translations are provided for information purposes only and may differ in content.
Only substantive Swiss law shall apply, excluding conflict of law rules and international agreements, in particular the UN Convention on Contracts for the International Sale of Goods (CISG).
